What To Do When Making A Personal Injury Claim

If you have suffered a personal injury through no fault of your own, you are likely to have many questions that you would like to have answered. Even if you have not suffered a personal injury, you may well want to know what may happen in the unfortunate event that you do. Depending on the circumstances, the answers to your questions can vary significantly. One of the most common personal injury claims are for car accidents. Here are some answers to frequently asked questions by those who have suffered from this.

If you are in a car accident you will need to report the accident to the DMV as you are required to by law. It is strongly recommended that you do not under any circumstances give a recorded statement to anybody, or admit responsibility for the accident – even if you were to blame. Instead you should only talk to your attorneys about the situation. If you are injured in the accident, take photos of your injuries so they can be used as evidence. Creating a “diary” of sorts of your injuries is always recommended as you will be able to show any prolonged effects that they have caused.

Photographic evidence is always useful when you are claiming compensation due to a personal injury. However it is also strongly recommended that you record the dates and times of any pain and or discomfort that you are also suffering from. This will play a vital role in gaining you the money that you feel you are entitled to. If you are not suffering from any pain immediately after the accident, you will still need to go to the hospital. If your not in any pain, it’s more than likely because your body has produced adrenaline to act as a natural pain killer – you may be more hurt than you realised!

In order for you to file your personal injury compensation claim, usually you will have needed to have completed your medical treatment. This is because part of the compensation claim will be based on any medical expenses, such as physiotherapy and even gym memberships which you have had to take up as part of your rehabilitation process. Once your claim has been made, it will usually take a few months before money arrives at your doorstep!
